TINJAUAN YURIDIS PENERAPAN PASAL 3 UNDANG-UNDANG PEMBERANTASAN TINDAK PIDANA KORUPSI TERHADAP DELIK KORUPSI PENYALAHGUNAAN KEWENANGAN OLEH PENYEDIA BARANG/JASA
Abstract
This research aims to know and analyze about the Provider of Goods Services as the perpetrator who misuses the authority, opportunity, or facilities available to him/her because Position Position as offense Article 3 of PTPK Law, private actors as the participant participate in the formulation of offense Article 3 of PTPK Law and Judicial consideration of the Panel of Judges concerning private actors found guilty of corruption as regulated in Article 3 of the PTPK Law and the private sector subject to Article 3 of the PTPK Law. This research is juridical normative legal research with research location in Yogyakarta State Court. The data sources used are primary and secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Technique of data collecting is done by documentary study technique, with data collecting instrument in the form of written materials, namely the decision of Yogyakarta District Court. The data analysis techniques using qualitative methods. Based on the result of research and discussion it is known that: Provider of Goods Services may act as the perpetrator who misuses the opportunity or facilities available to him because of the position as the offense Article 3 of the PTPK Law, including in the participation, the private actors can act as medepers in the formulation The offense of article 3 of the PTPK Law, but not in the qualification as the participation of misusing authority, Private actors who are found guilty of committing a criminal act of corruption with the indictment of Article 3 of the PTPK Law are private actors to commit misuse of the opportunity or facilities available to him because of his position, not because of his position; And In the procurement of Government Goods Services, the definition of an expanded official is not limited to the understanding of government officials in a broad sense, but private persons who have bind themselves as Providers of Goods Services in government procurement contracts are deemed to have positions Provide of Goods Services. Thus the qualification of such person is as an official of the Provider of Government Goods Services which has authority in the procurement
