PENERAPAN ASAS ITIKAD BAIK PADA PERJANJIAN KERJASAMA ENDORSEMENT PADA ONLINE SHOP DENGAN SELEBRITI INSTAGRAM DI KABUPATEN SLEMAN
Abstract
This study aims to examine the application of the principle of good faith to the endorsement cooperation agreement on an online shop with celebrity Instagram in Sleman Regency. This research was conducted by research methods in the form of library research and also field research. In library research the document study is used to obtain secondary data, while field research is conducted to obtain primary data through a qualitative approach, namely by interviewing. Data obtained from the results of library research and field research were analyzed qualitatively. The data is further elaborated by descriptive analysis method. Based on the results of the study note that the endorsement agreement between the online shop Reisa Garage and celebrity instagram in good faith both subjective and objective are applied at the pre-agreement stage and the implementation phase of the agreement. The application of the principle of good faith in the pre-agreement stage is demonstrated by the honesty of the parties during the negotiations regarding the types of merchandise to be reviewed and promoted as well as the value of the endorsement contract. The application of the good faith principle at the implementation stage of the agreement is indicated by the implementation of obligations or the fulfillment of achievements by one party to the other party in return in accordance with the contents of the agreement and the resolution of the problem by deliberation.
