PERLINDUNGAN HUKUM TERHADAP ANAK SEBAGAI KORBAN KEKERASAN DALAM RUMAH TANGGA DALAM PERSPEKTIF VIKTIMOLOGI

Abstract

Legal protection for victims of domestic violence is very important and needed because often victims are weak and need to be protected by their rights. In relation to victims of domestic violence, children are often victims of violence, acts of violence against children that are increasingly alarming need to be followed up by relevant parties and adequate regulations. The problem in this study is how the position of children as victims of domestic violence in the viewpoint of victimization and how the legal protection of children as victims of domestic violence in the perspective of victimization. This study aims to understand and analyze the position of children as victims of domestic violence in the viewpoint of victimization and to understand and analyze the legal protection of children as victims of domestic violence in the perspective of victimization. This research was conducted using a normative juridical approach is an approach based on the main legal material by examining the theories, concepts, principles of law and legislation relating to this research. This approach is also known as the literature approach, namely by studying books, legislation and other documents related to this research. Violence against children in the household environment has certain characteristics that make it difficult to enforce the law. The loss of children as victims of acts of violence committed by families, not only are material, but also immaterial includes emotional and psychological shocks, which directly or indirectly will affect their future lives. To provide adequate protection for a child, efforts to protect children must be supported by effective and comprehensive child protection laws. Legal protection for child victims of domestic violence, has not been explicitly and clearly regulated. So far, protection for children is contained in the UN Convention on the Rights of the Child, Law Number 23 Year 2002 concerning Child Protection, Law Number 23 Year 2004 concerning the Elimination of Domestic Violence.
