KEBIJAKAN PIDANA DALAM PEMBERANTASAN PENYALAHGUNAAN NARKOTIKA DI INDONESIA

Abstract

Narcotics have become one of the 6 (six) national problems in Indonesia since 1971, and until 2021 this problem will not subside, but will become more and more worrying. Judging from the aspect of legislation until the issuance of Law Number 35 of 2009 concerning Narcotics, it is actually considered sufficient as a legal instrument to take action against individuals or corporations suspected of violating the Act. As a Criminal Law Policy in the field of Narcotics which is a political policy by the owner of the authority, namely the President and the House of Representatives of the Republic of Indonesia, it has certainly gone through a long political process and many years of discussion by prioritizing the interests of the nation and state. Seeing the readiness of the regulations, it is necessary to look later on the quality of law enforcement or law enforcement against narcotics cases or cases that appear on the surface and are tried in court. Is it in accordance with the provisions of the Narcotics Act and fulfills our society's sense of justice. In addition, the National Narcotics Agency (BNN) is required to work hard to realize the ideals and expectations of the community in accordance with the orders of the Narcotics Law. In addition to the participation of the community to fully support the programs that have been outlined. This article uses a normative juridical approach while still paying attention to the practice of narcotics justice as well as the facts and symptoms that occur in our society. So the author in making this paper based on books that contain theories of criminal law, articles and applicable laws and regulations. However, the author believes that one aspect that needs attention is the role model of the figures and public figures who should set an example for the general public.
